The Commission for Protection of Competition allowed the concentration of trade activities constituting acquisition of independent control by Sisco Systems Inc., California, USA over Scientific –
Atlanta Inc., Georgia, USA as it was ascertained that it would not contribute to the creation of dominant position, considerably curbing the effective competition on the market.
It is only on the market of cable CPE equipment (equipment on the premises of the client) in Bulgaria that the parties have been competitors before the moment of execution of the transaction. Their
summed market shares, though, do not exceed the limit determined under art. 17, para 2 of the Law on Protection of Competition to define the line over which a dominant position is declared.
Together their market shares total around 23%. It has long been the Commission’s practice not to forbid a concentration that has been applied for on grounds of uncertain future events, such as, for
example, a change of the market shares of the companies concerned
